1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Tales N Tools LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of the Commonwealth of Virginia.

By accessing or using our websites, digital creator utilities, digital publications, webtoons, online merchandise portals, community hubs, or related digital services (collectively, the "Services"), you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of all Services.

2. Eligibility & Age Restrictions

You must be at least 13 years of age to access our general digital Services. If you are under 18 years of age, you represent that you have your parent or legal guardian's permission to use the Services.

3. Intellectual Property Rights

Unless otherwise explicitly indicated, all creative assets, original comic series, illustrations, manuscripts, character designs, lore bibles, software source code, graphics, branding, logos, trademarks, and multimedia content associated with Tales N Tools LLC, founder J. L. Richards, and series including Kitsunebi Eternal and Snowbound Ōkami are owned exclusively by or licensed to Tales N Tools LLC.

All rights are reserved under United States and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view our public content for personal, non-commercial enjoyment.

• You may not reproduce, resell, re-license, redistribute, or commercially exploit any artwork or story content without explicit prior written authorization from Tales N Tools LLC.
• You may not use our content, illustrations, or text to train, fine-tune, or populate generative AI models or automated scraping tools without express written consent.

4. Digital Creator Utilities & Assets

Tales N Tools LLC may develop and distribute digital creator utilities, brush packs, and templates. Your license to use any downloadable or web-based tools provided by the Company is governed by these Terms and any end-user license agreements (EULA) associated with the specific utility.

• Software is licensed, not sold, to you for individual authoring and creative workflow management.
• You agree not to reverse engineer, decompile, disassemble, or attempt to derive the source code of any proprietary software produced by Tales N Tools LLC except to the extent permitted by applicable law.
• Unless explicitly stated otherwise, software applications store data locally on your device. You are solely responsible for maintaining backup copies of your local files.

5. User Submissions & Fan Art License

When you voluntarily submit fan art, reviews, feedback, or community contributions ("Submissions") to Tales N Tools LLC via our submission forms, Discord, or official social channels:

You retain ownership of your original fan art, but grant Tales N Tools LLC a worldwide, non-exclusive, royalty-free, perpetual license to display, feature, share, and promote your Submission across our official websites, social media channels, and reader publications, with appropriate artist attribution.

6. Third-Party Platforms & External Links

Our Services contain links to third-party services and merchant storefronts, including Patreon, WEBTOON, Discord, custom merchandise printers, and social media platforms. Tales N Tools LLC does not control and is not responsible for the availability, content, privacy policies, or practices of third-party platforms.

7. User Conduct & Prohibited Activities

You agree not to use the Services to engage in unlawful activity, impersonate others, transmit harmful code or malware, interfere with the operation or security of our Services, or harass, threaten, or abuse company staff, creators, or community members.

8. Disclaimer of Warranties & Limitation of Liability

THE SERVICES, SOFTWARE, AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TALES N TOOLS LLC AND ITS MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES OR SOFTWARE.

9. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to your use of the Services shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without giving effect to any principles of conflicts of law.

You agree to submit to the exclusive personal jurisdiction of the state and federal courts located within the Commonwealth of Virginia for the resolution of any legal actions or proceedings.
